COPYRIGHT USE AGREEMENT FOR ACADEMIC USERS Altera Corporation ("Altera"), 101 Innovation Drive, San Jose, CA 95134 and Duncan Elliot ("User") University of Alberta, Department of Electrical and Computer Engineering, Edmonton, Alberta Canada T6G 2G7, enter into this Copyright Use Agreement for Academic Users on the 2nd day of February 1998. Altera is the owner of certain documentation, software, and other materials that are protected by the copyright laws of the United States and other countries ("Copyrighted Materials"). User has requested permission to use certain of Altera's Copyrighted Materials. Altera agrees to permit such use on the following term and conditions, and User agrees to be bound by these terms and conditions. 1. User will use the Copyrighted Materials for educational purposes only. 2. User may not edit, alter, or modify the Copyrighted Materials. However, User may copy a self-contained excerpt of the Copyrighted Materials and may incorporate such excerpt within User's technical or educational publication. 3. User may not use any graphics contained in the Copyrighted Materials separate from any accompanying text. 4. User may distribute copies of the Copyrighted Materials only to User's employees, User's suppliers, and customers and potential customers of Altera products. However, User may not charge any such person for this use. Any other distribution to third parties is prohibited unless User obtains the prior written consent of Altera. 5. User will include the following notice with any copies it makes of the Copyrighted Materials, including any technical or educational publications that incorporate any portion of the Copyrighted Materials: "Altera is a trademark and service mark of Altera Corporation in the United States and other countries. Altera products are the intellectual property of Altera Corporation and are protected by copyright laws and one or more U.S. and foreign patents and patent applications." 6. User will refer to Altera devices as CPLDs, not FPGAs. 7. User will use the most current version of Altera's Copyrighted Materials. If User is unsure whether it has the most current version, it will contact Altera Literature Services at (408) 544-7144. 8. This Academic License Agreement will automatically terminate if User fails to comply with any of its terms and conditions. 9. User will indemnify Altera for any claims asserted by any third party arising out of User's negligence or breach of any provision of this License Agreement. 10. Nothing contained in this License Agreement shall be construed as conferring by implication, estoppel, or any other legal theory, a license or right to any patent, trademark, copyright, or other intellectual property right of Altera, except those expressly provided herein. es not warrant the accuracy or completeness of the information, text, graphics, or other items contained within its Copyrighted Materials. Altera may make changes to the Copyrighted Materials or to the products described therein at any time without notice. Altera makes no commitment to update the Copyrighted Materials.
